大日本帝国憲法第二章とは臣民である日本国民の権利義務を示す規定である。条文は全部で15条。日本国憲法では全く想定していない非常事態に関する規定も存在する。ちなみに、20世紀に初めて認められた生存権、社会権は大日本帝国憲法には規定されていない。

第２章　臣民権利義務

第18条
- 原文：日本臣民タルノ要件ハ法律ノ定ムル所ニ依ル
- 意味：日本臣民である用件は法律の定めによる。
- 英文：Article 18. The conditions necessary for being a Japanese subject shall be determined by law.

日本臣民の規定。

第19条
- 原文：日本臣民ハ法律命令ノ定ムル所ノ資格ニ応シ均ク文武官ニ任セラレ及其ノ他ノ公務ニ就クコトヲ得
- 意味：日本臣民は法律の定める資格に応じ、誰でも平等に文武官に任せられ、その公務に就くことができる。
- 英文：Article 19. Japanese subjects may, according to qualifications determined in laws or ordinances, be appointed to civil or military or any other public offices equally.

平等に公務員になれる権利。

第20条
- 原文：日本臣民ハ法律ノ定ムル所ニ従ヒ兵役ノ義務ヲ有ス
- 意味：日本臣民は法律により徴兵の義務を有する。
- 英文：Article 20. Japanese subjects are amenable to service in the Army or Navy, according to the provisions of law.

兵役の義務。法律では女子と家督を継ぐ長男には兵役は免除された。

第21条
- 原文：日本臣民ハ法律ノ定ムル所ニ従ヒ納税ノ義務ヲ有ス
- 意味：日本国臣民は法律の定める所により納税の義務を有する。
- 英文：Article 21. Japanese subjects are amenable to the duty of paying taxes, according to the provisions of law.

納税の義務。

第22条
- 原文：日本臣民ハ法律ノ範囲内ニ於テ居住及移転ノ自由ヲ有ス
- 意味：日本臣民は法律の範囲において住居移転の自由を有する。
- 英文：Article 22. Japanese subjects shall have the liberty of abode and of changing the same within the limits of the law.

住居移転の自由。

第23条
- 原文：日本臣民ハ法律ニ依ルニ非スシテ逮捕監禁審問処罰ヲ受クルコトナシ
- 意味：日本臣民は法治主義に反する不当な逮捕監禁審問処罰を受けることはない。
- 英文：Article 23. No Japanese subject shall be arrested, detained, tried or punished, unless according to law.

不当な逮捕の禁止。

第24条
- 原文：日本臣民ハ法律ニ定メタル裁判官ノ裁判ヲ受クルノ権ヲ奪ハルヽコトナシ
- 意味：日本臣民は法律で定められた裁判官による裁判を受ける権利を有する。
- 英文：Article 24. No Japanese subject shall be deprived of his right of being tried by the judges determined by law.

公平に裁判を受ける権利。

第25条
- 原文：日本臣民ハ法律ニ定メタル場合ヲ除ク外其ノ許諾ナクシテ住所ニ侵入セラレ及捜索セラルヽコトナシ
- 意味：日本臣民は法律に定められた許諾・令状無しに不法に住居に侵入され捜査されることはない。
- 英文：Article 25. Except in the cases provided for in the law, the house of no Japanese subject shall be entered or searched without his consent.

住居不当進入の禁止。

第26条
- 原文：日本臣民ハ法律ニ定メタル場合ヲ除ク外信書ノ秘密ヲ侵サルヽコトナシ
- 意味：日本臣民は不法に手紙・通信の秘密を侵されることはない。
- 英文：Article 26. Except in the cases mentioned in the law, the secrecy of the letters of every Japanese subject shall remain inviolate.

通信の秘密。

財産権。

第28条
- 原文：日本臣民ハ安寧秩序ヲ妨ケス及臣民タルノ義務ニ背カサル限ニ於テ信教ノ自由ヲ有ス
- 意味：日本臣民は公共の秩序及び臣民の義務に背かない範囲にて信教の自由を有する。
- 英文：Article 28. Japanese subjects shall, within limits not prejudicial to peace and order, and not antagonistic to their duties as subjects, enjoy freedom of religious belief.

信教の自由。但し、反社会的な信教の自由は認めない。

第29条
- 原文：日本臣民ハ法律ノ範囲内ニ於テ言論著作印行集会及結社ノ自由ヲ有ス
- 意味：日本臣民は法律の範囲内にて言論著作印刷集会の結社の自由を有する。
- 英文：Article 29. Japanese subjects shall, within the limits of law, enjoy the liberty of speech, writing, publication, public meetings and associations.

言論、著作、印刷、集会、結社の自由。

第30条
- 原文：日本臣民ハ相当ノ敬礼ヲ守リ別ニ定ムル所ノ規程ニ従ヒ請願ヲ為スコトヲ得
- 意味：日本臣民は相当の敬礼を守り、別に定めた規定に従って、請願を行うことが出来る。
- 英文：Article 30. Japanese subjects may present petitions, by observing the proper forms of respect, and by complying with the rules specially provided for the same.

政治に意見を言う権利。請願権。

第31条
- 原文：本章ニ掲ケタル条規ハ戦時又ハ国家事変ノ場合ニ於テ天皇大権ノ施行ヲ妨クルコトナシ
- 意味：本章に掲げる条規は戦時または国家緊急事態の場合によって天皇大権の施行を妨げられることはない。
- 英文：Article 31. The provisions contained in the present Chapter shall not affect the exercises of the powers appertaining to the Emperor, in times of war or in cases of a national emergency.

臣民の権利義務は、戦時・国家事変の場合に制限されることを規定した。これを非常大権という。普通発動することは滅多に無いが、ごく普通の国は非常大権の所在をはっきりしている。

第32条
- 原文：本章ニ掲ケタル条規ハ陸海軍ノ法令又ハ紀律ニ牴触セサルモノニ限リ軍人ニ準行ス
- 意味：本章に掲げた条規は国軍の法令又は紀律に抵触しないものに限り軍人に準行する。
- 英文：Article 32. Each and every one of the provisions contained in the preceding Articles of the present Chapter, that are not in conflict with the laws or the rules and discipline of the Army and Navy, shall apply to the officers and men of the Army and of the Navy.
