大日本帝国憲法第六章とは国家運営に必要不可欠な予算に関する規定である。条文は全部で11条。日本国憲法では会計ではなく財政となっている。

第6章 会計

第62条

• 原文: 新ニ租税ヲ課シ及税率ヲ変更スルハ法律ヲ以テ之ヲ定ムヘシ
  2 但シ報償ニ属スル行政上ノ手数料及其ノ他ノ収納金ハ前項ノ限ニ在ラス
  3 国債ヲ起シ及予算ニ定メタルモノヲ除ク外国庫ノ負担トナルヘキ契約ヲ為スハ帝国議会ノ協賛ヲ経ヘシ
• 意味: 新たに租税を課し及び税率を変更するときは法律をもって定めるべし。
  2 但し報償にに属する行政上の手数料及びその他の収納金は前項に限らず。
  3 国債を起こし及び予算に定めたるものを除く国庫の負担となるべき契約をな成すため国会の協賛を得るべき。
• 英文: Article 62. The imposition of a new tax or the modification of the rates (of an existing one) shall be determined by law.
  (2) However, all such administrative fees or other revenue having the nature of compensation shall not fall within the category of the above clause.
  (3) The raising of national loans and the contracting of other liabilities to the charge of the National Treasury, except those that are provided in the Budget, shall require the consent of the Imperial Diet.

租税・国債の要件。

第63条

• 原文: 現行ノ租税ハ更ニ法律ヲ以テ之ヲ改メサル限ハ旧ニ依リ之ヲ徴収ス
• 意味: 現行の租税は更に法律により改められない限り現行の法律により徴収される。
• 英文: Article 63. The taxes levied at present shall, in so far as they are not remodelled by a new law, be collected according to the old system.

法律の変更無しに租税の基準を変更してはならないという基準。

第64条

• 原文: 国家ノ歳出歳入ハ毎年予算ヲ以テ帝国議会ノ協賛ヲ経ヘシ
  2 予算ノ款項ニ超過シ又ハ予算ノ外ニ生シタル支出アルトキハ後日帝国議会ノ承諾ヲ求ムルヲ要ス
• 意味: 国家の歳出歳入は毎年の予算をもって国会の協賛を経なければならない。
  2 予算の敢行に超過し又は予算の外に生じた支出があるときは後日国会の承諾を求めなければならない。
• 英文: Article 64. The expenditure and revenue of the State require the consent of the Imperial Diet by means of an annual Budget.
  (2) Any and all expenditures overpassing the appropriations set forth in the Titles and Paragraphs of the Budget, or that are not provided for in the Budget, shall subsequently require the approbation of the Imperial Diet.

歳出歳入と国会の決議。

第65条

• 原文: 予算ハ前ニ衆議院ニ提出スヘシ
• 意味: 予算案は先に衆議院に提出すべし。
• 英文: Article 65. The Budget shall be first laid before the House of Representatives.

衆議院の予算先議権。

第66条

• 原文: 皇室経費ハ現在ノ定額ニ依リ毎年国庫ヨリ之ヲ支出シ将来増額ヲ要スル場合ヲ除ク外帝国議会ノ協賛ヲ要セス
• 意味: 皇室経費は現在の定額により毎年国庫よりこれを支出し将来増額を要する場合を除き国会の協賛を必要としない。
• 英文: Article 66. The expenditures of the Imperial House shall be defrayed every year out of the National Treasury, according to the present fixed amount for the same, and shall not require the consent thereto of the Imperial Diet, except in case an increase thereof is found necessary.

皇室経費は増額する場合のみ国会の協賛を必要とするという規定。

第67条

• 原文: 憲法上ノ大権ニ基ツケル既定ノ歳出及法律ノ結果ニ由リ又ハ法律上政府ノ義務ニ属スル歳出ハ政府ノ同意ナクシテ帝国議会之ヲ廃除シ又ハ削減スルコトヲ得ス
• 意味: 憲法上の大権に基づく既定の歳出及び法律の結果により又は法律上政府の義務に属する歳出は政府の同意無くして国会により廃除又は削除することはできない。
• 英文: Article 67. Those already fixed expenditures based by the Constitution upon the powers appertaining to the Emperor, and such expenditures as may have arisen by the effect of law, or that appertain to the legal obligations of the Government, shall be neither rejected nor reduced by the Imperial Diet, without the concurrence of the Government.

憲法上の大権や国家運営に必修な予算は政府の同意無しに国会が削除・廃止してはならないという規定。

第68条

• 原文: 特別ノ須要ニ因リ政府ハ予メ年限ヲ定メ継続費トシテ帝国議会ノ協賛ヲ求ムルコトヲ得
• 意味: 特別の必要により政府は予め年限を定め継続費として国会の協賛を求めることができる。
• 英文: Article 68. In order to meet special requirements, the Government may ask the consent of the Imperial Diet to a certain amount as a Continuing Expenditure Fund, for a previously fixed number of years.

継続費に関する規定。大規模なインフラ整備を想定したもの。

第69条

• 原文: 避クヘカラサル予算ノ不足ヲ補フ為ニ又ハ予算ノ外ニ生シタル必要ノ費用ニ充ツル為ニ予備費ヲ設クヘシ
• 意味: 避けることができない予算の不足を補う為に又は予算外に生じた必要な予算を満たす為に予備費を設けるべし。
• 英文: Article 69. In order to supply deficiencies, which are unavoidable, in the Budget, and to meet requirements unprovided for in the same, a Reserve Fund shall be provided in the Budget.

予備費を設けることを義務づけた規定。

第70条

• 原文: 公共ノ安全ヲ保持スル為緊急ノ需用アル場合ニ於テ内外ノ情形ニ因リ政府ハ帝国議会ヲ召集スルコト能ハサルトキハ勅令ニ依リ財政上必要ノ処分ヲ為スコトヲ得
  2 前項ノ場合ニ於テハ次ノ会期ニ於テ帝国議会ニ提出シ其ノ承諾ヲ求ムルヲ要ス
• 意味: 公共の安全を保持する為に緊急の予算を必要とする場合、内外の事情により国会を召集できないときは勅令により緊急の予算を施行できる。
  2 前項の場合により次期国会に提出しその承諾を求める必要がある。
• 英文: Article 70. When the Imperial Diet cannot be convoked, owing to the external or internal condition of the country, in case of urgent need for the maintenance of public safety, the Government may take all necessary financial measures, by means of an Imperial Ordinance.
  (2) In the case mentioned in the preceding clause, the matter shall be submitted to the Imperial Diet at its next session, and its approbation shall be obtained thereto.

国家緊急事態においては、勅令により暫定予算を施行できるという規定。

勅令により施行された予算は次期国会での承認を必要とする。

第71条

• 原文: 帝国議会ニ於テ予算ヲ議定セス又ハ予算成立ニ至ラサルトキハ政府ハ前年度ノ予算ヲ施行スヘシ
• 意味: 国会はこれにて予算を議定し又は予算成立に到らないときは政府は前年度の予算を施行すべき。
• 英文: Article 71. When the Imperial Diet has not voted on the Budget, or when the Budget has not been brought into actual existence, the Government shall carry out the Budget of the preceding year.

予算成立が間に合わないときは去年の予算がそのまま施行されるという規定。

第72条

• 原文: 国家ノ歳出歳入ノ決算ハ会計検査院之ヲ検査確定シ政府ハ其ノ検査報告ト倶ニ之ヲ帝国議会ニ提出スヘシ
  2 会計検査院ノ組織及職権ハ法律ヲ以テ之ヲ定ム
• 意味: 国家の歳出歳入の決算は会計検査院のを検査確定し政府はその検査報告と共にこれを国会に提出する。
  2 会計検査院の組織及び職権は法律をもって定める。
• 英文: Article 72. The final account of the expenditures and revenues of the State shall be verified and confirmed by the Board of Audit, and it shall be submitted by the Government to the Imperial Diet, together with the report of verification of the said board.
  (2) The organization and competency of the Board of Audit shall of determined by law separately.

歳入歳出に関する規定。
